This policy sets out the legal terms under which visiting (“Guest”) tattoo artists operate within our studio (the “Studio”). By booking or receiving services from a Guest Artist at our premises, you (the “Client”) agree to these Terms.
1. Definitions
- Studio: [Rogue raven ink.], the provider of premises and facilities.
- Guest Artist: An independent tattoo artist temporarily operating from the Studio.
- Client: Any individual receiving services from a Guest Artist.
- Services: Tattooing and any related services provided by the Guest Artist.
2. Independent Contractor Relationship
- All Guest Artists operate as independent contractors.
- No partnership, employment, agency, or joint venture is created between the Studio and any Guest Artist.
- The Guest Artist acts in their own name, for their own account, and at their own risk.
3. Contract for Services
- Any contract for Services is strictly between the Client and the Guest Artist.
- The Studio is not a party to that contract and does not assume obligations arising from it.
4. Bookings, Pricing and Payments
- Bookings, deposits, pricing, and payment terms are set and handled solely by the Guest Artist.
- Payments are made directly to the Guest Artist unless expressly stated otherwise in writing.
- The Studio does not hold client funds, process payments, or manage deposits for Guest Artist Services.
5. Quality of Work and Outcomes
- The Guest Artist is solely responsible for the design, execution, and outcome of the tattoo.
- The Studio makes no representations or warranties (express or implied) regarding the quality, suitability, or outcome of the Services.
- Results may vary due to skin type, placement, lifestyle, and aftercare.
6. Complaints, Refunds and Chargebacks
- All complaints, refund requests, and disputes must be directed to the Guest Artist.
- The Studio is not responsible for issuing refunds or compensation for Guest Artist Services.
- The Client agrees not to initiate chargebacks or payment disputes against the Studio in relation to Guest Artist Services.
7. Studio Role and No Endorsement
- The Studio provides licensed premises, utilities, and general facilities.
- The Studio does not supervise, direct, or control the Guest Artist’s professional decisions or methods.
- The presence of a Guest Artist does not constitute endorsement, certification, or guarantee of their work.
8. Health, Hygiene and Aftercare
- Guest Artists are expected to comply with applicable hygiene standards and public health guidance in Ireland.
- The Client is responsible for following aftercare instructions provided by the Guest Artist.
- Healing complications may arise due to individual factors beyond the Studio’s control.
9. Medical Disclaimer
- Tattooing carries inherent risks including infection, allergic reaction, and variable healing.
- The Studio does not provide medical advice.
- The Client should seek independent medical attention if concerns arise.
10. Limitation of Liability
To the fullest extent permitted by Irish law:
- The Studio shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to Services performed by a Guest Artist.
- This includes, without limitation: dissatisfaction with results, fading, scarring, infection, or economic loss.
- The Studio’s liability is limited to providing a safe and compliant environment and shall not exceed any amount paid to the Studio (if any).
11. Indemnity
The Client agrees to indemnify and hold harmless the Studio, its owners, and staff from any claims, losses, damages, or expenses (including legal fees) arising out of or in connection with:
- Services performed by a Guest Artist;
- The Client’s breach of these Terms;
- The Client’s failure to follow aftercare instructions.
12. Client Acknowledgement and Assumption of Risk
By proceeding with a Guest Artist, the Client acknowledges that:
- He/She/They are contracting directly with the Guest Artist;
- The Studio is not responsible for the Services;
- He/She/They understand and accept the inherent risks associated with tattooing;
- He/She/They have had the opportunity to ask questions and provide informed consent.
13. Insurance and Licensing (Guest Artists)
- Guest Artists are required to maintain their own public liability and professional indemnity insurance where applicable.
- Guest Artists are responsible for ensuring they comply with all legal and regulatory requirements relevant to their practice.
14. Data Protection
- The Studio processes personal data in accordance with applicable GDPR and Irish data protection laws.
- Booking and service-related data handled directly by Guest Artists is their responsibility as independent controllers.
15. Dispute Resolution
- The parties agree to first attempt to resolve disputes amicably.
- Any dispute relating to Guest Artist Services should be directed to the Guest Artist.
16. Governing Law and Jurisdiction
- These Terms shall be governed by and construed in accordance with the laws of Ireland.
- Any disputes involving the Studio shall be subject to the exclusive jurisdiction of the Irish courts.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18. Amendments
The Studio reserves the right to amend these Terms at any time. The latest version will be published on our website.
By receiving services from a Guest Artist at our Studio, you confirm that you have read, understood, and agreed to these Terms and Conditions.
